en place et dispense des bilans de comp\u00e9tences et de l\u2019accompagnement VAE, \u00e0 Pithiviers, seule ou en partenariat.<\/span><\/p><p class=\"P4\"><span class=\"T5\">Objet et champ d\u2019application<\/span><\/p><p class=\"P6\"><span>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente d\u00e9terminent les conditions applicables aux prestations<\/span>&#x200b;&#x200b;&nbsp;<span>de formation effectu\u00e9es par l\u2019entreprise A Vis\u00e9e Pro pour le compte d\u2019un client. Toute commande de prestation aupr\u00e8s de la soci\u00e9t\u00e9 implique l\u2019acception sans r\u00e9serve du client des pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente. Ces conditions pr\u00e9valent sur tout autre document du client, en particulier sur toutes conditions g\u00e9n\u00e9rales d\u2019achat.<\/span><\/p><p class=\"P7\"><span class=\"T8\">Devis et attestation<\/span><\/p><p class=\"P9\"><span>Pour chaque prestation, l\u2019entreprise A Vis\u00e9e Pro s\u2019engage \u00e0 fournir un devis au client. Ce dernier est tenu de retourner \u00e0 l\u2019entreprise un exemplaire renseign\u00e9, dat\u00e9, sign\u00e9 et tamponn\u00e9, avec la mention \u00ab\u00a0Bon pour accord\u00a0\u00bb. \u00c0 la demande du client, une attestation de pr\u00e9sence ou de fin de formation peut lui \u00eatre fournie.<\/span><\/p><p class=\"P10\"><span class=\"T11\">Prix et modalit\u00e9s de paiement<\/span><\/p><p class=\"P12\"><span>Les prix des formations sont indiqu\u00e9s en euros hors taxes, exon\u00e9ration de TVA. Le paiement est \u00e0 effectuer apr\u00e8s ex\u00e9cution de la prestation, sous 8 jours \u00e0 r\u00e9ception de facture, au comptant. En cas de retard de r\u00e8glement, une facture de p\u00e9nalit\u00e9 sera envoy\u00e9e au taux de 4,22% par journ\u00e9e de retard. Le r\u00e8glement des<\/span>&#x200b;&#x200b;&nbsp;<span>factures peut \u00eatre effectu\u00e9 par virement bancaire ou par ch\u00e8que. Dans certains cas, un acompte peut-\u00eatre demand\u00e9.<\/span><\/p><p class=\"P13\"><span class=\"T14\">Pour les professionnels, une indemnit\u00e9 minimum forfaitaire de 40 euros pour frais de recouvrement sera exigible (D\u00e9cret 2012-1115 du 9 octobre<\/span><span class=\"T15\">&#x200b;&#x200b;&nbsp;2012).<\/span><\/p><p class=\"P16\">&nbsp;<\/p><p class=\"P17\"><span class=\"T18\">Prise en charge<\/span><\/p><p class=\"P19\"><span class=\"T20\">Si le client b\u00e9n\u00e9ficie d\u2019un financement par un Op\u00e9rateur de comp\u00e9tences (OPCO), il doit faire une demande de prise en charge avant le d\u00e9but de la prestation. Le client est tenu de fournir l\u2019accord de financement lors de l\u2019inscripti<\/span><span class=\"T21\">on. Dans le cas o\u00f9 l\u2019entreprise&#x200b;&#x200b;&nbsp;<\/span><span class=\"T22\">A Vis\u00e9e Pro ne re\u00e7oit pas la prise en charge de l\u2019OPCO au 1<\/span><span class=\"T23\">er<\/span><span class=\"T24\">&#x200b;&#x200b;&nbsp;jour de la prestation, l\u2019int\u00e9gralit\u00e9 des co\u00fbts de formation sera factur\u00e9e au client.<\/span><\/p><p class=\"P25\"><span class=\"T26\">Conditions de report et d\u2019annulation d\u2019une s\u00e9ance&#x200b;&#x200b;&nbsp;<\/span><\/p><p class=\"P27\"><span class=\"T28\">L\u2019annulation d\u2019une s\u00e9ance&#x200b;&#x200b;&nbsp;<\/span><span class=\"T29\">de formation est possible, \u00e0 condition de le faire au moins 10 jours calendaires avant le jour et l\u2019heure pr\u00e9vus. Toute annulation doit faire l\u2019objet d\u2019une notification par e-mail \u00e0 l\u2019adresse&#x200b;&#x200b;&nbsp;<\/span><a href=\"mailto:contact@a-visee-pro.fr\" target=\"_top\" title=\"\"><span class=\"T30\">contact@a-visee-p<\/span><span class=\"T31\">ro.fr<\/span><\/a><span class=\"T32\">&nbsp;&#x200b;&#x200b;&#x200b;&#x200b;&nbsp;<\/span><\/p><p class=\"P33\"><span>En cas d\u2019annulation entre 4 et 10 jours ouvrables avant le commencement du bilan, le client est tenu de payer une p\u00e9nalit\u00e9 d\u2019annulation, \u00e0 hauteur de 50% du co\u00fbt total initial de la formation. En cas d\u2019annulation moins de 3 jours ouvrables avant le<\/span>&#x200b;&#x200b;&nbsp;<span>d\u00e9but de la formation, une p\u00e9nalit\u00e9 d\u2019annulation correspondant \u00e0 10% du co\u00fbt total initial sera factur\u00e9e au client.<\/span><\/p><p class=\"P34\"><span>Une demande de report peut \u00eatre effectu\u00e9e par le client, \u00e0 condition d\u2019adresser une demande \u00e9crite \u00e0 l\u2019organisme de formation dans un d\u00e9lai<\/span>&#x200b;&#x200b;&nbsp;<span>de 10 jours avant la date de la formation.<\/span><\/p><p class=\"P35\"><span>En cas d\u2019inex\u00e9cution de ses obligations suite \u00e0 un \u00e9v\u00e9nement fortuit ou \u00e0 un cas de force majeur, l\u2019entreprise A Vis\u00e9e Pro ne pourra \u00eatre tenue responsable \u00e0 l\u2019\u00e9gard de ses clients. Ces derniers seront inform\u00e9s<\/span>&#x200b;&#x200b;&nbsp;<span>par mail.<\/span><\/p><p class=\"P36\"><span class=\"T37\">Programme des prestations r\u00e9alis\u00e9es<\/span><\/p><p class=\"P38\"><span>S\u2019il le juge n\u00e9cessaire, l\u2019intervenant pourra modifier les s\u00e9ances d\u2019accompagnement suivant le niveau des participants. Les contenus des programmes figurant sur les fiches de pr\u00e9sentation ne sont ainsi fournis<\/span>&#x200b;&#x200b;&nbsp;<span>qu\u2019\u00e0 titre indicatif.<\/span><\/p><p class=\"P39\"><span class=\"T40\">Propri\u00e9t\u00e9 intellectuelle et droit d\u2019auteur<\/span><\/p><p class=\"P41\"><span>Les supports donn\u00e9s, quelle qu\u2019en soit la forme (papier, num\u00e9rique, \u00e9lectronique\u2026), sont prot\u00e9g\u00e9s par la propri\u00e9t\u00e9 intellectuelle et le droit d\u2019auteur. Leur reproduction, partielle ou totale,<\/span>&#x200b;&#x200b;&nbsp;<span>ne peut \u00eatre effectu\u00e9e sans l\u2019accord expr\u00e8s de la soci\u00e9t\u00e9. Le client s\u2019engage \u00e0 ne pas utiliser, transmettre ou reproduire tout ou partie de ces documents en vue de l\u2019organisation ou de l\u2019animation de formations.<\/span><\/p><p class=\"P42\"><span class=\"T43\">Informatique et libert\u00e9s\u00a0&#x200b;&#x200b;&nbsp;<\/span><\/p><p class=\"P44\"><span>Les informations \u00e0 caract\u00e8re personnel communiqu\u00e9es par le client \u00e0 l\u2019entreprise A Vis\u00e9e Pro sont utiles pour le traitement de l\u2019inscription ainsi que pour la constitution d\u2019un fichier client\u00e8le pour des prospections commerciales. Suivant la loi \u00ab\u00a0informatique et libert\u00e9s\u00a0\u00bb du 6 janvier 1978, le client dispose d\u2019un droit d\u2019acc\u00e8s, de rectification et d\u2019opposition des donn\u00e9es personnelles le concernant.<\/span><\/p><p class=\"P45\"><span class=\"T46\">Loi applicable et attribution de comp\u00e9tence<\/span><\/p><p class=\"P47\"><span>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente sont encadr\u00e9es par la loi fran\u00e7aise.
